Preface

These general terms and conditions (hereinafter, “Terms & Conditions”) govern the participation of the user (“User”) in the “30 YEARS IN 24 HOURS” event (hereinafter, “Event”) of the artist Laura Pausini (hereinafter, “Artist”), organized by Gente Edizioni Musicali S.r.l, headquartered at Viale Bianca Maria, 28, 20121 Milan, Italy (hereinafter, “Gente”) and Friends & Partner S.p.A., headquartered at Via dei Sormani, 3, 20144 Milan, Italy (hereinafter, “FP” and collectively, “Organizers”).

1. Subject

The Event will consist of 3 (three) live shows open to the public and with free admission (hereinafter, “Show”), which the Artist will hold in New York (Apollo Theater), on February 26, 2023 6:00pm local time (12:00am CEST on 27.02.2023), in Madrid (Warner Music Station), on February 27, 2023 3:00pm local time, and in Milan (Teatro Carcano) on February 27, 2023 11:00pm local time.

2. Registration

Users wishing to participate in one of the three Shows must register on this website, developed specifically for this Event by Ticketmaster Italia S.r.l. (hereinafter, “Site”) and follow all instructions, review the Privacy Policy, and confirm that they have read and accepted these Terms & Conditions, which outline how to participate and how to obtain an invitation to attend the selected Show and the required Release Form for the taking and dissemination of photos and video footage, which are available on the Site.

Failure to accept the Terms & Conditions, the Release Form for the taking and dissemination of photos and video footage will result in the inability to complete the registration and, consequently, the User will not be able to participate in the selected Show.

The User must register by following the instructions outlined on the Site. Each User may select only 1 (one) Show and may only book up to a maximum of 2 (two) invitations for the selected Show, which will be allocated subject to availability for the selected Show. The User acknowledges that the Organizers may review submissions to ascertain that each User has registered for a single Show (up to a maximum of two invitations), reserving the right not to issue invitations should they become aware that a User has succeeded in registering for more than one Show.

When the maximum capacity for one or more of the Shows is reached, the label “NOT AVAILABLE” will be displayed next to the specific Show and the User will no longer be able to register for that Show, subject to the terms laid out paragraph 6 below.

Upon entering all mandatory information (including e-mail address and cell phone number, which will be used by the Organizers for Event-related service communications), the User will receive a confirmation message to the e-mail address provided.

3. Online check-in

After successfully registering on the Site, Users will be required to make an additional online registration (known as “check-in”) beginning February 22, 2023, via the designated service accessible through a link contained within the e-mail they will receive, in order to confirm participation in the selected Show and to fill in the remaining information of the individuals that will be using the invitations.

Upon clicking the link, the User must enter the code contained within the e-mail and will be redirected to the Ticket Master platform of the country in which the Show selected by the User will be held (e.g., if the User selected the Madrid Show during the initial registration process, they will be redirected to the Ticket Master Spain platform upon check-in). In order to complete this second registration phase and, therefore, obtain invitations to access the Show, the User must register with the Ticket Master platform of the country in which the Show selected by the User will be held, unless the User already holds a valid Ticket Master account for that particular country and can, therefore, log in with the credentials they already have.

Once the check-in process has been completed, the User will receive, via e-mail in PDF format, invitations for the selected Show from the Ticket Master platform of the country in which the Show they have selected will be held.

Online check-in can only be performed from 22/02/2023 at 3:00 PM (CET) — 9:00 AM (EST) to 23/02/2023 at 3:00 PM (CET) — 9:00 AM (EST).

FAILURE TO CHECK-IN BY 3:00 PM (CET) — 9:00 AM (EST) ON FEBRUARY 23, 2023, results in the User forfeiting the right to access the selected Show, without any refund or other form of compensation being payable to the User.

4. Invitation delivery methods and access to the Show

Upon successful completion of the online registration and check-in process and receipt via e-mail of invitations to enter the selected Show, the User may either print the invitations or save them on their smartphone and display them at the entrance of the venue of the selected Show. We recommend that the User arrive at the venue where the Show will be held at least one hour prior to the scheduled start of the Show.

Access to the Show is only permitted if the User has properly registered with the Site by following the instructions and has checked in online within the time limits set forth above in paragraph 3.

The Organizers reserve the right not to admit Users if they show up after the scheduled starting time of the Show, without any refund or other form of compensation to the User. Entry to the Show will be granted on a first-come, first-served basis. However, for organizational purposes, the Organizers reserve the right to issue serialized invitations during the check-in phase and to allocate seats based on the number found on the invitations.

Individuals with disabilities or limited mobility may request assistance to access the Show by sending an email, by 02/23/2023 3:00 pm (CET) - 9:00 am (EST) to the following address: laura30@friendsandpartners.it in order to report their needs and submit any required documentation, to enable the Organizers to provide the necessary assistance to access the Show. The processing of the personal data of the User who makes a request for assistance, including those falling under special categories pursuant to Article 9 of the General Data Protection Regulation (GDPR), will be carried out in accordance with the Privacy Policy that the User will receive at the earliest opportunity, i.e. when sending their e-mail request.

 

5. The transfer of invitations is forbidden

The Invitations to the Show bear the holder’s name. It is expressly forbidden to give, sell, donate, or otherwise transfer invitations by any means. Changing the names found on invitations is forbidden (provided that the name(s) of the holder(s), which may differ from that of the User who registered on the Site, are entered only at the time of check-in, a few days prior to the Show, as stated above in paragraph 3). The New York City show being the only exception, where you may request to change the name found on the invitation by following the instructions on the Site. The User acknowledges that identification screening may be conducted at the entrance and access will not be permitted in the event of failure to comply with the conditions set forth in the preceding paragraph (and in such case, the User will not be entitled to any refund, damages or any other form of compensation).

The User takes full responsibility for the accuracy of personal information entered during the check-in process for obtaining invitations for the selected Show, including with reference to the names, surnames, dates of birth and contact information (e-mail and/or cellphone number) of the other invitation holder(s) , and is liable in case of any false or fraudulent claims, as provided for in Article 76 of Presidential Decree 445/2000.

6. “Last Call”

Should one or more of the Shows NOT be at capacity by the conclusion of the registration and check-in periods, either due to the fact that they have not all been booked or because the check-in procedure has not been completed by the deadline and one or more Users have therefore lost the right to receive their invitation, the Artist shall announce a “last call,” in which they will invite their fans to register for the remaining seats, which shall be allocated until there are none left. In this case, Users who register on the Site for the last available seats will be redirected directly to the Ticket Master platform of the country in which the selected Show takes place, where they will have to register or log in, should they not already have an account with that platform, and will receive invitations, without having to go through the check-in procedure.

Those who had registered without completing the check-in procedure by the deadline will also be allowed to register during the Last Call, while those who have registered and already possess an invitation for a Show after having successfully completed the check-in procedure will not be allowed to re-register.

7. Exclusion of liability

The Organizer retains the right to change the program of the Event, i.e., the venue in which each Show will be held, the date and time of the Show, change the capacity of the venue, establish new access rules, without any refund or other form of compensation to the User in any of these cases.

Should one or more of the Shows be canceled or suspended, the User is not entitled to any refund, compensation or damages of any kind, not even with respect to any travel, lodging, food, etc., expenses necessary to reach, and return from, the Show location.

8. Release Form for the purpose of taking and disseminating photos and video footage

For the purpose of registering on the Site, the User shall accept and sign, bringing with them a signed copy, the Release Form for the taking and dissemination of photos and video footage available here (link), whereby the User grants to Gente and/or its successors/legal predecessors, including FP, completely free of charge, worldwide, and in perpetuity, the right to:

(i) film, photograph, record, and attach, including through third parties, by any means possible, including TV, their likeness, name, and voice, as well as their participation, over the course of the Event;

(ii) use the Images containing the participant’s likeness, name, voice, and participation in (i) the exploitation of the same by any possible means, including print, Internet, television, and any other means of communication to an attending and/or remote audience, such as but not limited to, websites, social media channels (Facebook, Instagram, Twitter, YouTube, etc.), and digital platforms of any kind, and (ii) the creation of materials of any kind, including promotional/advertising material, audiovisual content, docufilms, related to the Event and/or the Artist’s artistic and/or professional activities.

The User shall also instruct the person(s) using the other reserved invitation(s) to sign and bring with them a signed copy of the same Release Form mentioned above. In the absence thereof, the staff members present at the Show will ask all Show participants to sign the aforementioned Release Form.

Should a minor under the age of 18 attend the Event, the minor must come with the Release Form authorizing the taking and dissemination of photos and video footage signed by both parents or those exercising parental authority.

9. Personal Data Processing

The personal data of Users shall be processed in accordance with the Privacy Policy posted on the Site.

Prólogo

Las presentes condiciones generales (en adelante, "Condiciones Generales") regulan la participación del usuario ("Usuario") en el evento “30 YEARS IN 24 HOURS” (en adelante, "Evento") de la artista Laura Pausini (en adelante, "Artista" ), organizado por Gente Edizioni Musicali S.r.l., sociedad con domicilio social en Viale Bianca Maria, 28, 20121 Milán (en adelante, "Gente") y Friends & Partner S.p.A., sociedad con domicilio social en Via dei Sormani, 3, 20144 Milán (en adelante, "FP" y, en conjunto, "Organizadores").

1. Objeto

El Evento consistirá en n. 3 (tres) espectáculos en vivo abiertos al público y con entrada gratuita (en adelante, “Espectáculo”), que la Artista realizará en Nueva York (Apollo Theatre), el día 26 de febrero de 2023 hora local 18:00 (en Europa a las 00 ,00 del 27.02.2023); en Madrid (Warner Music Station), el 27 de febrero de 2023 hora local 15:30 horas; en Milán (Teatro Carcano) el 27 de febrero de 2023 hora local 22:30.

2. Inscripción

El usuario que desee participar en uno de los tres Espectáculos deberá registrarse en el sitio aquí desarrollado específicamente para el Evento por Ticketmaster Italia S.r.l.  (en adelante, el "Sitio") y seguir todas las instrucciones, confirmando que ha leído y aceptado las presentes Condiciones Generales, que explican cómo participar y cómo obtener una invitación para acceder al Espectáculo seleccionado, así como, una vez leída la política de privacidad, el formulario de autorización para tomar y difundir fotos y vídeos, todo ello disponible en el Sitio.

En caso de no aceptación de las Condiciones Generales, de la autorización para la creación y difusión de fotos y vídeos, no será posible completar la inscripción y, en consecuencia, el Usuario no podrá participar en el Salón seleccionado.

El Usuario debe registrarse siguiendo las instrucciones indicadas en el Sitio. Cada Usuario sólo podrá seleccionar n. 1 (un) Espectáculo y podrá reservar hasta un máximo de n. 2 (dos) invitaciones para el Espectáculo seleccionado, que se asignarán hasta cubrir todas las plazas disponibles para el Espectáculo seleccionado, sin perjuicio de las plazas reservadas por necesidades organizativas, de seguridad, de acreditación de prensa y de los socios comerciales.. El Usuario reconoce que los Organizadores podrán realizar comprobaciones para asegurarse de que cada Usuario ha seleccionado un único Espectáculo (hasta un máximo de dos invitaciones), reservándose el derecho -en caso de que se constate que un Usuario ha conseguido inscribirse en más de un Espectáculo- de no cursar las invitaciones.

Cuando se alcance el aforo máximo de uno o más de los Espectáculos, se indicará "NO DISPONIBLE" junto al Espectáculo en cuestión y el Usuario ya no podrá registrarse en dicho Espectáculo, salvo lo previsto en el siguiente apartado 6.

Al ingresar toda la información obligatoria (incluyendo la dirección de correo electrónico y el número de teléfono móvil, que serán utilizados por los Organizadores para las comunicaciones del servicio relacionado con el Evento), el Usuario recibirá un mensaje de confirmación en la dirección y el correo electrónico indicados.

3. Facturación en línea

Una vez que se haya completado con éxito el registro en el Sitio, salvo lo dispuesto posteriormente en el párrafo 6, los Usuarios deberán realizar un registro en línea adicional (llamado "check-in") a partir del 22 de febrero de 2023, utilizando el servicio apropiado accesible a través del enlace presente en el correo electrónico que recibirán, con el fin de confirmar la participación en el Espectáculo seleccionado e ingresar los datos solicitados de los usuarios de las invitaciones (que también pueden ser diferentes del Usuario que se registra).

Una vez hecho clic en el enlace, el Usuario deberá introducir el código contenido en el correo electrónico y será redirigido a la plataforma Ticket Master del país en el que se celebrará el Espectáculo seleccionado por el Usuario (por ejemplo, si el Usuario seleccionó el Espectáculo de Madrid durante el registro, el Usuario será redirigido a la plataforma Ticket Master de España al registrarse). Para completar esta segunda etapa de registro y obtener así invitaciones para acceder al Espectáculo, el Usuario deberá registrarse en la plataforma Ticket Master del país en el que se celebrará el Espectáculo seleccionado por el Usuario, a menos que el Usuario ya disponga de una cuenta Ticket Master válida para ese país y pueda, por tanto, iniciar sesión con las credenciales que ya posee.

Una vez completado el procedimiento de registro, el Usuario recibirá por correo electrónico, en formato PDF, las invitaciones para el Espectáculo seleccionado desde la plataforma Ticket Master del país en el que se celebrará el Espectáculo seleccionado por el Usuario.

La facturación en línea sólo se puede realizar a partir del 22/02/2023 h. 15:00 (CET) - h.9:00 am (EST) y hasta el 23/02/2023 h. 15:00 (CET) - h.9:00 am (EST).

EN CASO DE NO REALIZAR EL REGISTRO DE ENTRADA ANTES DE LAS 15:00 h (CET) - 9:00 h (EST) DEL 23 DE FEBRERO DE 2023, el Usuario perderá el derecho de acceso al Espectáculo seleccionado, sin que le corresponda ningún reembolso u otra forma de compensación..

4. Procedimiento de entrega de invitaciones y acceso al Espectáculo

Una vez que haya completado con éxito el procedimiento de inscripción y registro en línea y haya recibido las invitaciones por correo electrónico para acceder al Espectáculo seleccionado, podrá imprimir las invitaciones o guardarlas en su smartphone y mostrarlas a la entrada del Espectáculo seleccionado. Recomendamos al Usuario que llegue al Espectáculo al menos una hora antes de la hora prevista para el inicio del mismo.

Sólo se permitirá el acceso al Espectáculo en caso de que el Usuario se haya registrado correctamente en el Sitio siguiendo las instrucciones y se haya registrado en línea dentro de los plazos establecidos en el precedente apartado 3.

Los Organizadores se reservan el derecho a denegar el acceso a los Usuarios que se presenten después de la hora prevista para el inicio del Espectáculo, sin que por ello se deba al Usuario ningún reembolso u otra forma de compensación.

El acceso al Espectáculo se concederá por orden de llegada. No obstante, los Organizadores se reservan el derecho, por motivos de organización, de emitir invitaciones numeradas durante la fase de registro y de asignar las plazas en función de la numeración de las invitaciones.

Las personas con movilidad reducida o con discapacidad pueden solicitar asistencia para acceder al Salón enviando un correo electrónico, antes del 23/02/2023 h. 15:00 (CET) - h.9:00 am (EST) a la siguiente dirección:

 laura30@friendsandpartners.it, con el fin de informar de sus necesidades y transmitir la documentación solicitada, para que los Organizadores puedan preparar la asistencia necesaria para el acceso al Espectáculo. El tratamiento de los datos personales del Usuario que solicite asistencia, incluidos los comprendidos en categorías especiales de conformidad con el artículo 9 del Reglamento General de Protección de Datos (RGPD), se llevará a cabo de conformidad con la política de privacidad que el mismo recibirá a la mayor brevedad, es decir, cuando se envíe la solicitud por correo electrónico.

5. Prohibición de la transferencia de invitaciones a título oneroso. Cambio de nombre

Las invitaciones al Espectáculo son nominativas. Queda expresamente prohibido ceder, vender, donar o transferir invitaciones de cualquier otro modo.  No está permitido cambiar los nombres de las invitaciones (entendiéndose que los nombres de los usuarios, que también pueden ser diferentes del Usuario que se registra en el Sitio, se introducen únicamente en el momento del registro, unos días antes del Espectáculo, tal y como se indica en el anterior apartado 3). Sólo limitado al espectáculo de Nueva York, es posible solicitar un cambio de distintivo de llamada, siguiendo las instrucciones del Sitio.

El Usuario reconoce que se podrán realizar controles de identidad en la entrada y no se permitirá el acceso en caso de incumplimiento de lo dispuesto en el párrafo anterior (y en este caso, el Usuario no tendrá derecho a ningún reembolso, indemnización u otra forma de compensación).

El Usuario asume la responsabilidad de la veracidad de los datos personales introducidos durante el procedimiento de registro para la obtención de invitaciones para el Espectáculo seleccionado, incluso en lo referente a los nombres, apellidos, fechas de nacimiento y datos de contacto (correo electrónico y/o teléfono) de los usuarios de las invitaciones, y será responsable en caso de declaración falsa o mendaz, según lo previsto en el artículo 76 del Decreto Presidencial 445/2000.

Es posible cambiar las invitaciones accediendo con la propia cuenta a la plataforma Ticket Master del país en el que tendrá lugar el Espectáculo seleccionado y siguiendo las instrucciones que allí se indican.

6. Última llamada

En el caso de que, al finalizar los procedimientos de inscripción y registro, queden localidades disponibles para uno o varios de los Espectáculos, bien porque no se hayan reservado todas o bien porque no se haya completado el procedimiento de registro en el plazo previsto y, por tanto, uno o varios Usuarios hayan perdido el derecho a recibir su invitación, los Organizadores a través de sus canales oficiales, incluidos los canales oficiales de la Artista, anunciarán una "última llamada", en la que invitarán a sus fans a inscribirse para las últimas plazas disponibles, que se asignarán en función de la disponibilidad. En este caso, los Usuarios que se registren en el Sitio para las últimas localidades disponibles serán redirigidos directamente en la plataforma Ticketmaster del país en el que se celebre el Espectáculo seleccionado, donde deberán registrarse o iniciar sesión, si aún no disponen de una cuenta en dicha plataforma, y recibirán sus invitaciones, sin tener que pasar por el procedimiento de registro.

Quienes se hayan inscrito sin haber completado el procedimiento de registro dentro del plazo establecido también podrán inscribirse en la Última Llamada, mientras que quienes se hayan inscrito y, habiendo completado con éxito el procedimiento de registro, ya estén en posesión de una invitación para un Espectáculo no podrán volver a inscribirse.

7. Exclusión de responsabilidad

El Organizador se reserva el pleno derecho de modificar el programa del Evento, es decir, el lugar donde tendrá lugar cada Espectáculo, la fecha y hora del mismo, modificar el aforo de la sala, establecer nuevas normas de acceso, sin que en ninguno de estos casos se produzca reembolso o compensación alguna para el Usuario.

En caso de cancelación o suspensión de uno o más de los Espectáculos, el Usuario no tendrá derecho a obtener reembolso, compensación o indemnización de ningún tipo, ni siquiera en relación con los gastos de viaje, alojamiento, comida, etc. necesarios para llegar al lugar del Espectáculo y regresar de él.

8. Autorización para la creación y difusión de fotos y vídeos

A los efectos de registrarse en el Sitio, el Usuario deberá aceptar y firmar, trayendo consigo una copia firmada, la autorización para la creación y difusión de fotos y videos aquí disponibles, por la cual el Usuario cede a Gente y/o sus sucesores / cesionarios, incluyendo FP, en forma totalmente gratuita, para todo el mundo y a perpetuidad, el derecho a:

• filmar, fotografiar, grabar y fijar, también a través de terceros, por cualquier medio posible, incluida la televisión, la propia imagen, nombre y voz y la propia participación en el Evento;

• utilizar las Imágenes que contengan su imagen, nombre, voz y participación para (i) la explotación de las mismas por cualquier medio posible, incluidos medios impresos, Internet, televisión y cualquier otro medio de comunicación a una audiencia presente y/o remota, tales como, entre otros, sitios web, canales sociales (Facebook, Instagram, Twitter, YouTube, etc.) y plataformas digitales de cualquier tipo y (ii) la producción de materiales de cualquier tipo, incluidos materiales promocionales/publicitarios, contenidos audiovisuales, docufilms, relacionados con el Evento y/o con la actividad artística y/o profesional del Artista.

El Usuario también pedirá al usuario de la otra invitación reservada que firme y traiga consigo una copia firmada de la misma autorización mencionada anteriormente. En su defecto, en cualquier caso, los operadores presentes en el Espectáculo pedirán a todos los participantes en el Espectáculo que firmen la autorización mencionada.

En caso de participación de un menor de 18 años, el menor deberá acudir con la autorización para la realización y difusión de fotos y vídeos firmada por ambos padres/ejercitantes de la patria potestad, de lo contrario no será admitido al Espectáculo.

9. Tratamiento de datos personales

Los datos personales de los usuarios se tratarán de acuerdo con la política de privacidad publicada en el Sitio.
